COMPULSORY SOCIAL INSURANCE PROGRAMS (BHXH)

1. SICKNESSES

Cases eligible for benefits:

  • Employees participating in social insurance who are sick or have an accident other than an occupational accident or occupational disease (occupational disease) or have a recurring occupational accident or occupational disease must quit work with confirmation from a medical facility;
  • Must take leave from work to care for a sick child under 7 years old and have confirmation from a competent medical facility.
  • Female employees who return to work before the end of their maternity leave and fall into the above cases.

VD: Based on the table below, Mr. A has paid social insurance for 5 years. In January 2016, A was sick and had to take 32 days off (from January 3 to February 3, 2016 ® 23 working days). Salary in December 2015= 3 million ® sickness allowance = ((75%*3 million)/24)*23= 2,156,250

2. MATERNITY

  • Cases eligible for benefits:

  • Female employees who return to work before the end of their maternity leave period, after taking at least 4 months of leave and notifying the employer, are still entitled to maternity benefits in addition to salary.

3. MODE OF OCCUPATIONAL ACCIDENTS (Occupational accidents), OCCUPATIONAL DISEASES (BNN):

  • Condition:

Having an accident while working or performing work at the request of the employer / on the way to and from work / got sick on the list of occupational diseases issued by the Ministry of Health and the Ministry of Labor, Invalids and Social Affairs ; working capacity decrease of 5% or more.

  • Odd months of paying social insurance premiums:

5. ONE TIME SOCIAL INSURANCE (OR CALLED: RECEIVING ONE TIME SOCIAL INSURANCE BENEFIT)

a. Cases entitled to one-time social insurance benefits:

  • Having reached the retirement age but paying social insurance premiums for less than 20 years;
  • After one year of quitting your job, if you do not pay social insurance + there is a request to receive a one-time social insurance benefit + less than 20 years of social insurance payment (according to Resolution 93/2015/QH13 dated June 22, 2015), this is a common case.
  • People who are suffering from one of the life-threatening diseases such as cancer, polio, cirrhosis, ascites, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS and other diseases according to regulations of the Ministry of Health;
  • Go abroad to settle.

b. Benefit level: calculated based on the number of years of social insurance payment, for each year:

  • Equal to 1.5 months of average salary paid for social insurance for years of payment before 2014;
  • Equal to 2 months’ average salary on which social insurance premiums are paid for the years of payment from 2014 onwards.
  • In case you have not paid for 1 full year, it is equal to the amount of social insurance paid, up to 2 months of average salary paid for social insurance. = Min(amount paid for social insurance, 2 months average salary paid for social insurance)

Example: Mr. A pays social insurance premiums from January 2013 to December 2016 with a salary of 5 million VND

6. DEATH REGIME

  • Funeral allowance (one-time allowance):
  • For employees’ relatives when: The employee is paying/reserving time to pay social insurance but has paid in full for 12 months or more; Employees die due to occupational accidents/occupational diseases; Employees who are receiving pensions or occupational accident/work disease benefits have quit their jobs; was declared dead by the Court.
  • The benefit level is equal to 10 times the base salary in the month the employee dies.
  • Monthly death benefit:
  • Condition:
  • Employees who meet the above conditions are in the following cases: having paid social insurance premiums for 15 years, not yet enjoying one-time social insurance/ are enjoying monthly occupational accident or occupational disease allowance with a decrease in labor >= 61%/ are enjoying pension/ death due to occupational accidents, occupational diseases;
  • Relatives who are unable to work, family members who are being raised by the employee under the responsibility of the employee, have no income or have an income lower than the base salary.
  • Monthly allowance: 50% of the base salary/each relative, 70% if the relative cannot take care of themselves;

Note:

  • The number of relatives must not exceed 4 people/employee
  • If 2 or more people die: each parent receives 100% of the base salary.
  • One-time survivor allowance:
  • Conditions: do not fall into the above cases, or the employee has no relatives, or according to the wishes of the employee’s relatives.
  • One-time allowance:
  • For employees participating/reserving social insurance: calculated based on the number of years of social insurance payment similar to one-time social insurance;
  • For employees receiving pension: if they have only received 2 months of pension, they will receive 48 months of pension; If you receive more than 2 months of pension, for each month you receive pension, the benefit will be reduced by 0.5 months.

Other notes::

  • If an employee does not work for pay for 14 days or more in a month, the EMPLOYER AND EMPLOYER do not pay social insurance, and it is not included in the time of social insurance payment.
  • The calculation of retirement and survivorship benefits, if the period of payment of social insurance is odd, then: From 1-6 months = half a year, from 7-11 months = 1 year.
  • If the employee has a monthly salary > 20 times the base salary ® the monthly salary paid for social insurance is equal to 20 times the base salary.
  • Employees receive social insurance money through: the employer, the employee’s account at the bank or at the social insurance agency where the employee resides.
  • Compulsory social insurance for foreign workers when working in Vietnam:

Currently, foreign workers working in Vietnam do not have to pay social insurance (Clause 2, Article 2 of the 2014 Law on Social Insurance), but by January 1, 2018, they are required to participate in social insurance contributions for foreign workers. outside working in Vietnam (Article 124 of the Law on Social Insurance 2014 on the effect)

 

7. COMPULSORY HEALTH INSURANCE 2017 (Health Insurance)

  • When a person with a health insurance card receives medical treatment at the wrong level, the health insurance agency will pay:
  • Central hospital: 40% of inpatient treatment costs;
  • Provincial hospital: 60% of inpatient treatment costs from January 1, 2015 to December 31, 2020; 100% of inpatient treatment costs from January 1, 2021 nationwide
  • District hospital: 100% of medical examination and treatment costs (specified in Clauses 1, 2, 3, 9 and 10, Article 2 of Circular No. 37/2014/TT-BYT)

  • Compulsory health insurance for foreign workers working in Vietnam:

The current health insurance premium rate for foreign workers working in Vietnam is: 4.5% of salary and wages, of which the employer pays 3%, the employee pays 1.5% (Clause 1 of Article 1 of this Law). 2 Decree 105/2014/ND-CP)

  • Salary and wages paid for health insurance are the monthly salary and wages stated in the labor contract. In case this salary or remuneration is higher than twenty months of the general minimum salary, the monthly salary and wages for which health insurance premiums are based shall be equal to 20 months of the common minimum salary.

 

8. UNEMPLOYMENT INSURANCE (BHTN)

  • Right:

Mức hưởng trợ cấp thất nghiệp:60% mức bình quân tiền lương tháng đóng bảo hiểm thất nghiệp của 06 tháng liền kề trước khi thất nghiệp (tối đa không quá 05 lần mức lương cơ sở (NLĐ hưởng lương từ NSNN) hoặc không quá 05 lần mức lương tối thiểu vùng (Lương do người sử dụng lao động quyết định tại thời điểm chấm dứt hợp đồng lao động hoặc hợp đồng làm việc). Đề nghị hưởng trợ cấp theo mẫu;

Bản chính/bản sao có chứng thực: hợp đồng LĐ/làm việc đã kết thúc, hoặc quyết định thôi việc/sa thải/kỷ luật buộc thôi việc, hoặc thông báo/ thỏa thuận chấm dứt HĐLĐ/làm việc;

Sổ BHXH

Trung tâm dịch vụ việc làm tại địa phương nơi NLĐ muốn nhận trợ cấp thất nghiệp.
Hỗ trợ học nghề Người lao đông đang thất nghiệp và đã đóng BHXH từ 9 tháng trở lên Đ/v NLĐ đang hưởng trợ cấp TN: đề nghị hỗ trợ hộc nghề theo quy định;

Đ/v NLĐ đang hưởng trợ cấp TN: đề nghị hỗ trợ hộc nghề theo quy định;

Đ/v người thất nghiệp đã đóng BHTN >= 9 tháng nhưng không đủ điều kiện hưởng trợ cấp: đề nghị hỗ trợ học nghề theo quy định, bản chính/bản sao các giấy tờ theo khoản 2, điều 16 và sổ BHXH.

Trung tâm dịch vụ việc làm nơi NLĐ đang hưởng trợ cấp thất nghiệp hoặc trung tâm mà NLĐ có nhu cầu học nghề.
  • Hằng tháng, NSDLĐ tự động đóng và trích tiền lương của NLĐ cùng lúc với đóng BHXH bắt buộc.
  • Hồ sơ theo dõi BHTN là sổ BHXH.
  • Những điều cần lưu ý:
  • Đ/v trợ cấp thất nghiệp:
  • Trong thời hạn 3 tháng (kể từ ngày chấm dứt HĐ), NLĐ chưa có việc làm và có nhu cầu hưởng trợ cấp phải trực tiếp nộp 1 bộ hồ sơ theo quy định cho trung tâm dịch vụ việc làm địa phương nơi NLĐ muốn nhận trợ cấp.
  • Thời điểm hưởng trợ cấp thất nghiệp: tính từ ngày thứ 16 (theo ngày làm việc) kể từ ngày nộp hồ sơ.
  • Cơ quan chi trả trợ cấp: tổ chức BHXH. (Điều 18, NĐ 28/2015)
  • Sau 2 ngày làm việc kể từ ngày ghi trong giấy hẹn trả kết quả, nếu NLĐ không đến nhận quyết định hưởng trợ cấp ® coi như là không có nhu cầu hưởng trợ cấp, thời gian đóng BHXH của NLĐ trong trường hợp này được cộng dồn cho lần sau. (Khoản 5, Điều 18, NĐ 28/2015)
  • Thời gian hưởng trợ cấp: tính theo số tháng đóng BHTN.
  • Đ/v hỗ trợ NSDLĐ: Tổ chức BHXH tạm ứng 50% kinh phí hỗ trợ theo quy định của Chủ tịch UBND cấp tỉnh.
  • Thời gian hưởng tính theo thời gian đóng BHTN, trong đó:
  • Đóng đủ 1-3 năm® 3 tháng trợ cấp;
  • Cứ đủ thêm 1 năm ® thêm 1 tháng trợ cấp;
  • Tối đa không quá 12 tháng.
  • BHTN cho người lao động nước ngoài làm việc tại Việt Nam:
